Without Prejudice is used as:
- The term will be mainly used within a discussion and/or correspondence. If the term is used correctly, it can be an effective way for all parties of a dispute/claim to protect themselves and their businesses whilst saving time and costs by out of court settlement disputes. But even when using ‘without prejudice’ within a discussion and/or correspondence, they can still end up before a court of law for consideration
- Without Prejudice is, a term that can be used by an underwriter when paying a claim, which they feel, may not attach to a policy. The claim payment may not be treated as a usual practice for future similar claims.
